Horn\u00e1 Mi\u010din\u00e1, v obci Horn\u00e1 Mi\u010din\u00e1,<\/p>\n<p><u>pre st<\/u><u>a<\/u><u>v<\/u><u>e<\/u><u>bn\u00edka<\/u><u>:<\/u> Filipa Mi\u0161urca, bytom 974 01 Horn\u00e1 Mi\u010din\u00e1 250<\/p>\n<p>Hlavn\u00fd projektant predlo\u017eenej projektovej dokument\u00e1cie stavby je Viera Rendekov\u00e1 Agroprojekt &#8211; B.B., Str\u00e1\u017eovsk\u00e1 2, 974 11 Bansk\u00e1 Bystrica.<\/p>\n<p>Predmetom rozhodnutia s\u00fa stavby:<\/p>\n<ul>\n<li><strong>Oporn\u00e9 m\u00fary <\/strong><\/li>\n<li><strong>Oplotenie<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Popis stavby:<\/p>\n<h3>Oporn\u00e9 m\u00fary<\/h3>\n<p>Skladaj\u00fa\u00a0\u00a0 a z dvoch samostatn\u00fdch celkov, ktor\u00e9 s\u00fa zlo\u017een\u00e9 z viacer\u00fdch vetiev. Jeden celok v tvare U je z \u013eavej bo\u010dnej pozdl\u017enej strany pozemku na hranici so susedn\u00fdm pozemkom ved\u013eaj\u0161ieho rodinn\u00e9ho domu a druh\u00fd celok v tvare U je z pravej bo\u010dnej pozd\u013a\u017enej strany pozemku a zadnej strany. T\u00fdmto rie\u0161en\u00edm s\u00fa vytvoren\u00e9 oporn\u00e9 m\u00fary, ktor\u00e9 dr\u017eia cel\u00fd predmetn\u00fd pozemok u\u017e stojaceho rodinn\u00e9ho domu a cel\u00e9ho upraven\u00e9ho dvora, ktor\u00fd je oproti okolit\u00fdm pozemkom zdvihnut\u00fd o 1,25m a\u017e 2,25m nad upraven\u00fd ter\u00e9n okolia. Oporn\u00e9 m\u00fary tvoria celok zo \u017dB kon\u0161trukcie, vytvoren\u00fd zo z\u00e1kladu a drieku. Pod\u013ea evidencie katastra nehnute\u013enost\u00ed s\u00fa dotknut\u00e9 parcely KN-C 681\/7, 681\/17 a 681\/35 evidovan\u00e9 pod\u013ea katastra nehnute\u013enost\u00ed na LV 1088, vo vlastn\u00edctve stavebn\u00edka.<\/p>\n<p>Na z\u00e1klade doru\u010denej \u017eiadosti o dodato\u010dn\u00e9 povolenie stavby bol vykonan\u00fd \u0161t\u00e1tny stavebn\u00fd doh\u013ead Obcou Horn\u00e1 Mi\u010din\u00e1 d\u0148a 13.01.2023. a z\u00e1klade miestneho \u0161etrenia a z\u00e1veru zo \u0161t\u00e1tneho stavebn\u00e9 doh\u013eadu bol tento z\u00e1ver post\u00fapen\u00fd na Obec \u00a0Horn\u00e1 Mi\u010din\u00e1-stavebn\u00fd \u00farad.<\/p>\n<p>Obec Horn\u00e1 Mi\u010din\u00e1 &#8211; stavebn\u00fd \u00farad ozn\u00e1mila listom \u010d. Oc\u00da 323\/2022\/ozn. zo d\u0148a 23.01.2023 v s\u00falade s \u00a788a v spojen\u00ed s \u00a788 ods. 1 p\u00edsm. b) stavebn\u00e9ho z\u00e1kona konanie o dodato\u010dnom povolen\u00ed stavby spojen\u00e9ho s kolauda\u010dn\u00fdm povolen\u00edm a nariadila \u00fastne pojedn\u00e1vanie spojen\u00e9 s kolaud\u00e1ciou na de\u0148 22.02.2023 o 10:00 hod. Z konania bol sp\u00edsan\u00fd protokol.<\/p>\n<p>V priebehu dodato\u010dn\u00e9ho povolenia stavby a kolauda\u010dn\u00e9ho konania pri miestnom zis\u0165ovan\u00ed d\u0148a 22.02.2023 neboli na stavbe zisten\u00e9 nedostatky, ktor\u00e9 by br\u00e1nili trval\u00e9mu u\u017e\u00edvaniu stavby. Potrebn\u00e9 doklady ku dodato\u010dn\u00e9mu povoleniu a kolaud\u00e1cii boli predlo\u017een\u00e9. Na stavbe neboli zisten\u00e9 nedostatky, ktor\u00e9 by br\u00e1nili vydaniu rozhodnutia.<\/p>\n<p>U\u017e\u00edvan\u00edm stavby nebude ohrozen\u00fd \u017eivot a zdravie os\u00f4b, ani \u017eivotn\u00e9 prostredie. V konan\u00ed neboli vznesen\u00e9 n\u00e1mietky \u00fa\u010dastn\u00edkov konania. V podmienkach kolauda\u010dn\u00e9ho rozhodnutia stavebn\u00fd \u00farad zaviazal navrhovate\u013ea na re\u0161pektovanie podmienok u\u017e\u00edvania stavby pod\u013ea \u00a782 stavebn\u00e9ho z\u00e1kona.<\/p>\n<p>Stavebn\u00fd \u00farad v priebehu konania nezistil nedostatky, ktor\u00e9 by br\u00e1nili trval\u00e9mu u\u017e\u00edvaniu stavby a preto stavebn\u00fd \u00farad rozhodol tak, ako je uveden\u00e9 vo v\u00fdrokovej \u010dasti tohto rozhodnutia.<\/p>\n<p>Za vydanie tohto rozhodnutia v zmysle z\u00e1k. \u010d. 145\/1995 Z.z. o spr\u00e1vnych poplatkoch v znen\u00ed z\u00e1kona \u010d. 583\/2003 Z.z., stavebn\u00edk zaplatil spr\u00e1vny poplatok vo v\u00fd\u0161ke 90,- \u20ac do pokladne Obce Horn\u00e1 Mi\u010din\u00e1.<\/p>\n<p>&nbsp;<\/p>\n<h2>Pou\u010denie<\/h2>\n<p>Proti rozhodnutiu m\u00e1 \u00fa\u010dastn\u00edk konania pr\u00e1vo poda\u0165 odvolanie v zmysle \u00a753 a \u00a754 z\u00e1kona \u010d. 71\/1967 Zb. o spr\u00e1vnom konan\u00ed v lehote do 15 dn\u00ed odo d\u0148a jeho doru\u010denia. Odvolanie sa pod\u00e1va na spr\u00e1vnom org\u00e1ne, ktor\u00fd rozhodnutie vydal. Rozhodnutie je po vy\u010derpan\u00ed riadnych opravn\u00fdch prostriedkov presk\u00famate\u013en\u00e9 s\u00fadom v zmysle z\u00e1kona \u010d. 162\/2015 Z.z. Spr\u00e1vny s\u00fadny poriadok.<\/p>\n<p>&nbsp;<\/p>\n<p>Ivan Len\u00e1r starosta obce<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>Toto rozhodnutie m\u00e1 povahu verejnej vyhl\u00e1\u0161ky pod\u013ea \u00a769 ods. 1 stavebn\u00e9ho z\u00e1kona, v spojen\u00ed. s \u00a726 ods. 2 z\u00e1kona \u010d. 71\/1967 Zb. o spr\u00e1vnom poriadku a mus\u00ed by\u0165 toto rozhodnutie vyvesen\u00e9 po dobu 15 dn\u00ed na \u00faradnej tabuli Obce Horn\u00e1 Mi\u010din\u00e1 a 15-ty de\u0148 tejto lehoty je d\u0148om doru\u010denia tohto rozhodnutia \u00fa\u010dastn\u00edkom konania.
