Horn\u00e1 Mi\u010din\u00e1, obec: Horn\u00e1 Mi\u010din\u00e1, okres: Bansk\u00e1 Bystrica, ktor\u00fd je zap\u00edsan\u00fd na liste vlastn\u00edctva \u010d. 417 vedenom Okresn\u00fdm \u00faradom\u00a0Bansk\u00e1 Bystrica, katastr\u00e1lnym odborom , ktor\u00e9ho v\u00fdlu\u010dn\u00fdm vlastn\u00edkom je pred\u00e1vaj\u00faci v\u00a0podiele 1\/1<\/li>\n<\/ul>\n<\/li>\n<li>(\u010falej len ako <strong style=\"text-align: center;\">\u201enehnute\u013enosti\u201c)<\/strong><\/li>\n<\/ol>\n<\/li>\n<li>Predmetom tejto zmluvy je prejav v\u00f4le pred\u00e1vaj\u00faceho previes\u0165 zo svojho v\u00fdlu\u010dn\u00e9ho vlastn\u00edctva vlastn\u00edcke pr\u00e1vo k\u00a0nehnute\u013enostiam do v\u00fdlu\u010dn\u00e9ho vlastn\u00edctva kupuj\u00faceho za k\u00fapnu cenu uveden\u00fa v\u00a0\u010dl\u00e1nku III. tejto zmluvy a\u00a0za podmienok stanoven\u00fdch v\u00a0tejto zmluve a s\u00fa\u010dasne prejav v\u00f4le kupuj\u00faceho nadobudn\u00fa\u0165 nehnute\u013enosti do svojho v\u00fdlu\u010dn\u00e9ho vlastn\u00edctva za k\u00fapnu cenu uveden\u00fa v \u010dl\u00e1nku III. tejto zmluvy a\u00a0za podmienok uveden\u00fdch v\u00a0tejto zmluve.<\/li>\n<\/ol>\n<ol start=\"3\">\n<li>Kupuj\u00faci prehlasuje, \u017ee sa pred podpisom tejto k\u00fapnej zmluvy obozn\u00e1mil so stavom nehnute\u013enost\u00ed a\u00a0v\u00a0tomto stave ich od pred\u00e1vaj\u00faceho kupuje tak ako stoja a\u00a0le\u017eia. Pred\u00e1vaj\u00faci prehlasuje, \u017ee nehnute\u013enosti nemaj\u00fa pr\u00e1vne vady.<\/li>\n<\/ol>\n<h3><em><strong>\u010cl\u00e1nok III. &#8211;\u00a0<\/strong><\/em><em><strong>K\u00fapna cena<\/strong><\/em><\/h3>\n<ol>\n<li>Zmluvn\u00e9 strany sa dohodli na k\u00fapnej cene za nehnute\u013enosti nasledovne:<\/li>\n<li>pred\u00e1vaj\u00faci pred\u00e1 svoj v\u00fdlu\u010dn\u00fd vlastn\u00edcky podiel o\u00a0ve\u013ekosti 1\/1 k nehnute\u013enostiam, kupuj\u00facemu do jeho v\u00fdlu\u010dn\u00e9ho vlastn\u00edctva, a\u00a0to za k\u00fapnu cenu 26,86 Eur\/m2, cena spolu za 251 m2 = 6\u00a0741,86 Eur <em>(slovom:<\/em> \u00a0\u0161es\u0165tis\u00edcsedemsto\u0161tyridsa\u0165jeden\/86 <em>Eur).<\/em><\/li>\n<li>Zmluvn\u00e9 strany sa dohodli, \u017ee kupuj\u00faci uhrad\u00ed pred\u00e1vaj\u00facemu k\u00fapnu cenu bezhotovostn\u00fdm prevodom na \u00fa\u010det pred\u00e1vaj\u00faceho uveden\u00fd v\u00a0z\u00e1hlav\u00ed tejto zmluvy do 3 dn\u00ed od podpisu tejto zmluvy.<\/li>\n<li>K\u00fapna cena sa pova\u017euje za uhraden\u00fa prip\u00edsan\u00edm pe\u0148a\u017en\u00fdch prostriedkov na \u00fa\u010det pred\u00e1vaj\u00faceho .<\/li>\n<\/ol>\n<h3><em><strong>\u010cl\u00e1nok IV. &#8211;\u00a0<\/strong><\/em><em><strong>Vyhl\u00e1senia zmluvn\u00fdch str\u00e1n<\/strong><\/em><\/h3>\n<ol>\n<li>Pred\u00e1vaj\u00faci obozn\u00e1mil kupuj\u00faceho so stavom prev\u00e1dzan\u00fdch nehnute\u013enost\u00ed a kupuj\u00faci t\u00fato skuto\u010dnos\u0165 podpisom tejto zmluvy potvrdzuje, pri\u010dom nehnute\u013enosti kupuje v\u00a0stave, v\u00a0akom sa nach\u00e1dzaj\u00fa v \u010dase podpisu tejto zmluvy, s\u00a0vedom\u00edm skutkov\u00e9ho stavu v\u00a0akom sa nehnute\u013enosti nach\u00e1dzaj\u00fa.<\/li>\n<li>Kupuj\u00faci prehlasuje, \u017ee m\u00e1 dostatok finan\u010dn\u00fdch prostriedkov na k\u00fapu nehnute\u013enost\u00ed a\u00a0je schopn\u00fd dodr\u017ea\u0165 platobn\u00e9 podmienky uveden\u00e9 v\u00a0tejto zmluvy.<\/li>\n<li>Pred\u00e1vaj\u00faci vyhlasuje, \u017ee :\n<ol style=\"list-style-type: lower-alpha;\">\n<li>je opr\u00e1vnen\u00fd s\u00a0nehnute\u013enos\u0165ami vo\u013ene disponova\u0165, a\u00a0toto jeho pr\u00e1vo nie je ni\u010d\u00edm a\u00a0nik\u00fdm obmedzen\u00e9;<\/li>\n<li>nehnute\u013enosti pred podpisom tejto zmluvy v\u0161etk\u00fdmi zmluvn\u00fdmi stranami nepredal, nedaroval ani in\u00fdm sp\u00f4sobom nepreviedol na tretiu osobu\/tretie osoby, ani ich nevlo\u017eil do \u017eiadnej obchodnej spolo\u010dnosti alebo dru\u017estva, ani nevykonal in\u00fd \u00fakon, na z\u00e1klade ktor\u00e9ho m\u00f4\u017ee by\u0165 do pr\u00edslu\u0161n\u00e9ho katastra nehnute\u013enost\u00ed zap\u00edsan\u00e1 tretia osoba\/tretie osoby ako vlastn\u00edci nehnute\u013enost\u00ed;<\/li>\n<li>po podpise tejto zmluvy v\u0161etk\u00fdmi zmluvn\u00fdmi stranami, t. j. po uzavret\u00ed tejto zmluvy, nehnute\u013enosti nepred\u00e1, nedaruje ani in\u00fdm sp\u00f4sobom neprevedie na tretiu osobu\/tretie osoby, ani ju nevlo\u017e\u00ed do \u017eiadnej obchodnej spolo\u010dnosti alebo dru\u017estva, ani nevykon\u00e1 in\u00fd \u00fakon, na z\u00e1klade ktor\u00e9ho m\u00f4\u017ee by\u0165 do pr\u00edslu\u0161nej evidencie nehnute\u013enost\u00ed zap\u00edsan\u00e1 tretia osoba\/tretie osoby ako vlastn\u00edci nehnute\u013enosti;<\/li>\n<li>ku d\u0148u podpisu tejto zmluvy zmluvn\u00fdmi stranami na predmete k\u00fapy neviaznu \u017eiadne z\u00e1lo\u017en\u00e9 pr\u00e1va ani ak\u00e9ko\u013evek in\u00e9 pr\u00e1va tret\u00edch os\u00f4b, ktor\u00e9 by obmedzovali vlastn\u00edka predmetu zmluvy v\u00a0jeho dr\u017ebe, u\u017e\u00edvan\u00ed a\u00a0po\u017e\u00edvan\u00ed plodov a\u00a0\u00fa\u017eitkov s\u00a0n\u00edm spojen\u00fdch a v\u00a0disponovan\u00ed s\u00a0n\u00edm;<\/li>\n<li>k nehnute\u013enostiam v\u00a0bud\u00facnosti nevznikne in\u00e9 z\u00e1lo\u017en\u00e9 pr\u00e1vo ani ak\u00e9ko\u013evek in\u00e9 pr\u00e1vo tret\u00edch os\u00f4b, ktor\u00e9 by obmedzovalo vlastn\u00edkov nehnute\u013enost\u00ed v\u00a0ich dr\u017ebe, u\u017e\u00edvan\u00ed a\u00a0po\u017e\u00edvan\u00ed plodov a\u00a0\u00fa\u017eitkov s\u00a0nimi spojen\u00fdch a v\u00a0disponovan\u00ed s\u00a0n\u00edm, a\u00a0ktor\u00e9 by mali svoj p\u00f4vod v\u00a0akomko\u013evek konan\u00ed a\/alebo opomenut\u00ed pred\u00e1vaj\u00faceho;<\/li>\n<li>nem\u00e1 vedomos\u0165 o\u00a0tom, \u017ee by ku d\u0148u podpisu tejto zmluvy v\u0161etk\u00fdmi zmluvn\u00fdmi stranami prebiehali s\u00fadne konania, exeku\u010dn\u00e9 konania alebo in\u00e9 konania pred ak\u00fdmko\u013evek \u0161t\u00e1tnym org\u00e1nom, spr\u00e1vnym org\u00e1nom, org\u00e1nom \u0161t\u00e1tnej spr\u00e1vy alebo samospr\u00e1vy veden\u00e9 proti pred\u00e1vaj\u00facemu, ktor\u00e9 by svoj\u00edm \u00fa\u010dinkom mohli znemo\u017eni\u0165, obmedzi\u0165, oddiali\u0165 alebo inak s\u0165a\u017ei\u0165 prevod vlastn\u00edckeho pr\u00e1va k\u00a0nehnute\u013enostiam na kupuj\u00faceho, a ktor\u00e9\u00a0po nadobudnut\u00ed vlastn\u00edckeho pr\u00e1va k nehnute\u013enostiam kupuj\u00facim ohrozia alebo s\u00fa sp\u00f4sobil\u00e9 ohrozi\u0165 vlastn\u00edcke pr\u00e1vo kupuj\u00faceho.<\/li>\n<\/ol>\n<\/li>\n<li>Zmluvn\u00e9 strany s\u00fa viazan\u00e9 svojimi zmluvn\u00fdmi prejavmi do rozhodnutia o vklade vlastn\u00edckeho pr\u00e1va v katastri nehnute\u013enost\u00ed.<\/li>\n<li>Zmluvn\u00e9 strany sa dohodli, \u017ee n\u00e1vrh na vklad vlastn\u00edckeho pr\u00e1va k Predmetu zmluvy do katastra nehnute\u013enost\u00ed pod\u00e1 advok\u00e1tska kancel\u00e1ria M&amp;L advok\u00e1tska kancel\u00e1ria s.r.o., so s\u00eddlom na ulici Hurbanova 8, 974 01 Bansk\u00e1 Bystrica, Slovensk\u00e1 republika, I\u010cO: 50 926 284, zap\u00edsan\u00e1 v Obchodnom registri vedenom Okresn\u00fdm s\u00fadom Bansk\u00e1 Bystrica, oddiel: Sro, vlo\u017eka \u010d\u00edslo: 32064\/S (\u010falej aj len ako \u201eAdvok\u00e1tska kancel\u00e1ria\u201c) v lehote do troch pracovn\u00fdch dn\u00ed od prip\u00edsania k\u00fapnej ceny na \u00fa\u010det Pred\u00e1vaj\u00faceho, o \u010dom Pred\u00e1vaj\u00faci upovedom\u00ed N\u00e1klady spojen\u00e9 s osved\u010den\u00edm podpisu na Zmluve zn\u00e1\u0161a Pred\u00e1vaj\u00faci a n\u00e1klady spojen\u00e9 s n\u00e1vrhom a povolen\u00edm vkladu vlastn\u00edckeho a z\u00e1lo\u017en\u00e9ho pr\u00e1va zn\u00e1\u0161a Kupuj\u00faci.<\/li>\n<li>Zmluvn\u00e9 strany podpisom na tejto Zmluve splnomoc\u0148uj\u00fa Advok\u00e1tsku kancel\u00e1riu na podanie n\u00e1vrhu na vklad vlastn\u00edckeho pr\u00e1va do katastra nehnute\u013enost\u00ed vr\u00e1tane zastupovania v celom katastr\u00e1lnom konan\u00ed vypl\u00fdvaj\u00faceho z tejto Zmluvy a to v celom rozsahu pr\u00e1v a povinnost\u00ed pod\u013ea tejto Zmluvy, v pr\u00edpade potreby opr\u00e1v ch\u00fdb v p\u00edsan\u00ed resp. po\u010d\u00edtan\u00ed alebo vzniknut\u00fdch nezrovnalost\u00ed t\u00fdkaj\u00facich sa uzavretej Zmluvy. Zmluvn\u00e9 strany s\u00fa\u010dasne splnomoc\u0148uj\u00fa Advok\u00e1tsku kancel\u00e1riu k vykonaniu v\u0161etk\u00fdch pr\u00edpadn\u00fdch dodatkov, zmien a opr\u00e1v tejto Zmluvy, aby nebol zmaren\u00fd \u00fa\u010del tejto Zmluvy.<\/li>\n<li>Kupuj\u00faci nadobudne vlastn\u00edctvo k\u00a0nehnute\u013enosti povolen\u00edm vkladu vlastn\u00edckeho pr\u00e1va do katastra nehnute\u013enost\u00ed Okresn\u00fdm \u00faradom Bansk\u00e1 Bystrica, katastr\u00e1lnym odborom.<\/li>\n<\/ol>\n<h3><em><strong>\u00a0<\/strong><\/em><em><strong>\u010cl\u00e1nok V. &#8211;\u00a0<\/strong><\/em><em><strong>Z\u00e1vere\u010dn\u00e9 ustanovenia<\/strong><\/em><\/h3>\n<ol>\n<li>T\u00e1to zmluva nadob\u00fada platnos\u0165 d\u0148om jej podp\u00edsania v\u0161etk\u00fdmi zmluvn\u00fdmi stranami, \u00fa\u010dinnos\u0165 d\u0148om nasleduj\u00facim po dni jej zverejnenia, pri\u010dom \u00fa\u010dinky prevodu v\u00fdlu\u010dn\u00e9ho vlastn\u00edctva k\u00a0nehnute\u013enosti nast\u00e1vaj\u00fa okamihom povolenia vkladu vlastn\u00edckeho pr\u00e1va do katastra nehnute\u013enost\u00ed.<\/li>\n<li>T\u00fato zmluvu mo\u017eno meni\u0165 a dop\u013a\u0148a\u0165 p\u00edsomn\u00fdm dodatkom podp\u00edsan\u00fdm v\u0161etk\u00fdmi zmluvn\u00fdmi stranami.<\/li>\n<li>Zmluvn\u00e9 strany sa podpisom tejto zmluvy zav\u00e4zuj\u00fa navz\u00e1jom si bez zbyto\u010dn\u00e9ho odkladu poskytn\u00fa\u0165 ak\u00fako\u013evek s\u00fa\u010dinnos\u0165 potrebn\u00fa na to, aby bol kupuj\u00faci zap\u00edsan\u00ed ako vlastn\u00edk nehnute\u013enosti do pr\u00edslu\u0161n\u00e9ho katastra nehnute\u013enost\u00ed, a\u00a0to aj vr\u00e1tane pr\u00edpadn\u00e9ho uzavretia dodatku\/dodatkov k\u00a0tejto zmluve v\u00a0pr\u00edpade, ak to bude pod\u013ea pr\u00edslu\u0161n\u00fdch \u0161t\u00e1tnych org\u00e1nov potrebn\u00e9 na odstr\u00e1nenie nezrovnalost\u00ed, resp. nespr\u00e1vnost\u00ed v\u00a0nej uveden\u00fdch.<\/li>\n<li>Pr\u00e1vne pomery touto zmluvou neupraven\u00e9 sa spravuj\u00fa ustanoveniami Ob\u010dianskeho z\u00e1konn\u00edka a\u00a0in\u00fdch pr\u00e1vnych predpisov platn\u00fdch v\u00a0Slovenskej republike.<\/li>\n<li>Zmluva je vyhotoven\u00e1 v\u00a04 vyhotoveniach, z\u00a0toho 2 vyhotovenia s\u00fa ur\u010den\u00e9 na podanie Okresn\u00e9mu \u00faradu Bansk\u00e1 bystrica, katastr\u00e1lny odbor, po jednom vyhotoven\u00ed obdr\u017e\u00ed ka\u017ed\u00e1 zmluvn\u00e1 strana.
